instructions to injured clients

1.         Talk to no one:  do not talk to anyone about your accident or your lawsuit except when you are in our office.  Remember, anything you say may be used against you later.  Everything you tell your attorney is privileged and confidential.   You should report the accident itself to your insurance company as soon as possible. it may be best for to consult with our office prior to providing detailed information to your own insurance company or to any lawyers hired by your own insurance company.  your statement can be misinterpreted or taken out of context.   We will generally want these types of interviews or statement to be taken in our office. 

2.         your doctor: You should return to each of your doctors as often as necessary and should always tell them about all of your complaints.  You should not minimize or exaggerate your ailments to your doctor because that is the best way your doctor will know how to treat you.  If you see any additional doctors, be sure we are advised immediately of their names and addresses. You should also follow the advice of your doctor concerning other treatment suggestions, such as physical therapy and follow-up visits.

3.         Record of complaints:  please keep a daily or weekly record of your complaints and progress.  Your case will probably not be settled or go to trial for many months.  This record will help you be able to recall your pain and difficulties.

4.         Lost wages and earnings:  please keep an accurate record of all days lost from work because of your injuries.  Also keep up with overtime pay if possible.

5.         Medical bills:  obtain and keep duplicate copies of all medical, hospital and drug bills.  You should periodically send these bills to us for our files.  You should make and keep a list of all your medical bills and the costs incurred in going to your doctor.  Also keep records of any other expenses you may have in connection with your accident such as the hiring of extra help.  This includes costs for house keeping, yard work and transportation.

6.         Car repair:  do not have your automobile repaired or sold until you are sure that we have obtained pictures of it.  After pictures are taken by this office, have your collision insurance carrier repair or replace your car.

7.         Traffic offenses:  never plead guilty to any traffic offenses and if you are arrested in connection with this accident, call us and we will see that you are advised.

8.         Witnesses:  furnish to us immediately the correct names and addresses and telephone numbers of any and all witnesses you may learn of later.

  

9.         Save your cast:  if your injury requires a cast, brace, traction, or other appliance, save it for evidence and trial.  You should notify us that you are

Keeping these things and when the case is set for deposition, settlement conference or hearing you should bring these items with you.

10.       Photographs:  send us the negatives and prints of any photographs pertaining to your case which you or any of your family or friends have taken.  You should make pictures or video showing your injuries, including any casts, braces, etc., you are using.  If you are required to be in the hospital and are receiving any type of treatment like traction or physical therapy, please notify me.

11.       Hospital and doctor bills:  have your own health  insurance carrier (not car insurance) pay as many hospital and doctor bills under the provisions of your policy as possible.  Doctors and hospitals are more cooperative when their bills are paid.  You should not expect them to wait until your case is tried or settled to receive payment.  If you get any collection notices from your medical providers send them to us as soon as possible.  We will try to preserve your good credit.

12.       Questions:  we usually do not contact our clients until we have something definite to report.  We will be contacting you for depositions, answers to interrogatories, settlement negotiations, and when your case is scheduled for trial.

13.       Your address:  be sure to keep us advised of any change in your address or telephone numbers.
